This document constitutes a binding public offer (agreement) between the individual entrepreneur / self-employed individual acting under the Professional Income Tax (PIT) regime of the Republic of Belarus (hereinafter referred to as the "Provider") and any individual who accepts these terms (hereinafter referred to as the "User").
1.1. The Provider grants the User a non-exclusive, revocable right to use the web application for automated AI-powered image processing (hereinafter referred to as the "Service").
1.2. The Service provides image generation based on artificial intelligence models via third-party API integration. The services are provided entirely in digital form via the Internet. In accordance with Decree No. 8 "On the Development of the Digital Economy" of the Republic of Belarus, this transaction constitutes an electronic service provided remotely.
2.1. Full and unconditional acceptance of this Public Offer occurs when the User performs any of the following actions: creating an account via email, uploading an image, or making a payment.
2.2. The Service operates on a credit-based system. Processing packages are purchased according to the current pricing specified on the website ($4.99 for 10 credits).
2.3. Payments are processed via integrated international cryptocurrency gateways (NOWPayments). By initiating a transaction, the User acknowledges that cryptocurrency conversions and network fees are governed by the respective platform rules.
3.1. Due to the nature of digital goods and immediate consumption of computing resources, ALL SALES ARE FINAL.
3.2. Once digital credits are consumed or added to the User's balance, no refunds, chargebacks, or cancellations will be issued, unless the service fail was purely technical on the Provider's side and credits were not delivered.
4.1. The Service utilizes third-party neural networks. The Provider does not guarantee specific artistic results, exact facial matches, or absolute precision of the generated images. The service is provided on an "AS IS" and "AS AVAILABLE" basis.
4.2. The User retains ownership of the uploaded images and is solely responsible for ensuring they have the legal right to use them. The User strictly agrees not to upload images containing nudity, violence, copyrighted material without permission, or any content that violates international laws.
5.1. The Provider processes the User's email solely for authentication purposes and saving the credit balance.
5.2. Images uploaded by the User are temporarily stored via secure CDN (Uploadcare) and sent to Replicate API for processing. The Provider does not store, sell, or train models on the User's personal biometric data or private photographs.
6.1. This Agreement shall be governed by, and construed in accordance with, the substantive laws of the Republic of Belarus. Any disputes that cannot be resolved through friendly negotiations shall be subject to the exclusive jurisdiction of the competent courts in the Provider's place of registration.
